Introduction of Environmental Crimes within Legislative Decree 231/01

On 7 July the Italian government approved the extension of Legislative Decree 231/01 to include environmental crimes. The inclusion of these crimes implies an extension of corporate responsibility by introducing a system of sanctions, which includes environmental crimes.

Legislative Decree 231/01 introduced, into Italian legislation, the administrative liability of corporate bodies, if a person associated with the company commits one of the crimes or illegal administrative acts specifically provided for in the Decree.

Other crimes, among which are those concerning companies, those associated with aspects of safety at work and, since 7 July, environmental crimes, were subsequently added to crimes against Public Administration.

This extension determines the need for companies to protect themselves by implementing the organization and control model and observing environmental issues (in particular, production and waste management, and soil and subsoil contamination).

Note that this Legislative Decree also regulates foreign companies operating in Italy.
